Citizenship Status For Baby Born Mid-Air Flight Journey

A pregnant mother on doctor’s approval boarded flight and delivered a baby mid-air flight. US Greencard holder Phillipine citizen mother traveling from Manila to SFO, US delivered a baby boy during her flight journey. The questions arises of the baby boy’s citizen ship status if he can be granted US citizenship or Greencard.

If the flight is in US Territory then the birth of the boy automatically makes him/her a a US citizen. Since the delivery happened outside the US territory, the citizenship status raised questions.

Inquirer post summarized the final status of baby boy Kevin :

Kevin having been born to a green card holder mother, outside the US territory is considered to be a child born abroad of a green card parent. His mother is on her initial entry to the US and so the rule applies that no visa is required of Kevin. He can automatically be registered as a green card holder.
